We, as the Breeder, do everything possible to produce healthy, sound puppies, by raising them in the best way possible regarding diet, exercise, socialization, and veterinary care.  The puppy you have selected is guaranteed by Walnut Creek Kennel to the original purchaser.  This puppy has had all immunizations and wormings needed according to veterinarian standards for the age of this puppy.  This puppy appears to be of sound body, and in good health, as far as appears to the eye at the time of purchase.  

We guarantee each puppy to be free of all Communicable, Life-Threatening Disease for a period of 3 business days (providing the puppy is not exposed to a sick dog in your car or otherwise within those three days).  Seller assumes no responsibility for the puppy after leaving our premises for accident, injury, disagreement of family members, veterinarian exams, medications, disease, behavior (including “the puppy jumps too much”, nips, bites---or any behavior that just needs a firm hand to train your puppy to have correct behavior), or for any other reasons.  Therefore, this guarantee does not cover, and will not accept returns (even if it is in the first 3 business days) for the sole reason, (but not limited to) that “the puppy whines too much”, or “we didn’t want another job”, or “this is getting to be expensive”, “it’s just not what we thought”, etc, etc, etc. 

If puppy is to be returned to the breeder, the return should occur within 7 days with all registration papers and health papers, as well as a signed statement from the Buyer’s vet, stating the date of examination and the alleged health risks. The return transportation is at the Buyer’s expense.  NO MONIES WILL BE REFUNDED.  UNDER NO CIRCUMSTANCE WILL BREEDER BE RESPONSIBLE FOR VETERINARY BILLS, TRANSPORTATION FEES, OR ANY EXPENSES THAT THE BUYER HAS INCURRED.  This is a puppy replacement guarantee only.  Breeder has one year to provide a replacement pup of equal value, or from the next available unrelated litter.

In the unlikely event of a death of a puppy in the first 7 days, the Buyer will need to provide proof of death by a necropsy report stating cause of death. The report should be completed by a licensed veterinarian, signed, and should be submitted on the vet's letterhead.  Credit will be given in the form of a replacement puppy of equal value if the puppy’s death was caused from a life-threatening disease or condition, only.   Transportation of the replacement puppy will be paid by the breeder.  No replacement will be made until AKC (or otherwise) registration papers are returned to the Seller.

THE BUYER:

1.  Is to consult a Veterinarian of their choice within 3 business days of purchase to assure that they will follow through with this puppy’s health care.  If, within those 3 days, or up to a year from purchase, the buyer’s veterinarian finds that this puppy has a congenital defect that is life-threatening and is unfit for purchase, contact us immediately with the medical report, signed by your vet, submitted on his letterhead, and we will exchange the puppy for another of equal value and of your choice when such a puppy becomes available, and at our discretion.  The seller will pay for the shipping of the exchange puppy.  We reserve the right to have the puppy examined by our vet prior to a replacement.  The Buyer has the choice to either keep said pup or accept a replacement pup from next available litter.  NO MONEY WILL BE REFUNDED.

2. Understands and agrees that, while we do our best to insure that our puppies are genetically sound, we cannot guarantee the lifetime health of any puppy beyond its condition at the time of sale.  The Buyer will provide adequate medical care including heartworm preventative and yearly vaccination.  Providing adequate exercise and human contact is a necessity in owning any puppy or dog.  It is imperative that you take care not to expose your new puppy to strange dogs, public places, etc. until it has completed all vaccinations your vet recommends.  Until then it is very susceptible to dangerous airborne viruses, such as Parvo, that can kill in as little as 24 hrs.  Walnut Creek Kennel is not responsible for communicable diseases that the puppy may come in contact with after leaving us, so please stay safe and get the vaccinations to protect your puppy! If you haven’t, this guarantee shall become void.

3. Needs to be aware of what is involved in taking care of a puppy; including the adjustment to a new environment without any siblings, and also the expenses involved in caring for a puppy.  Taking care of a puppy is a job in itself, requires much time and attention on your part, and does include expenses!  Purchasing a puppy should not be an impulsive decision and it is your responsibility to understand that you are making a decision for the lifetime of the puppy.

4.  Is aware that we do NOT pay veterinary bills incurred under any circumstances and that NO REFUNDS will be given, as they are taking full responsibility for this puppy from this date forward.

The change of environment may cause stress-related problems:

-------Coccidiosis (a type of intestinal infection)

-------Tracheobronchitis (a relatively minor upper respiratory problem)

-------Hypoglycemia

-------Dehydration (usually from not drinking enough water)

All of the above are very treatable with medication.  These physical problems are often brought on by unavoidable stress, and are similar to problems you might have if you were moving to a new area.  Just like you, the puppy may not eat or sleep as regularly as it would in more familiar surroundings.  Some puppies ease through the transition to their new home, while others may have a harder time.  If stress-related problems are ignored, secondary problems can become serious, even life-threatening.

This puppy is sold as “Pet Quality” but may have “Show Potential”.  However, since puppies change as they mature, Breeder cannot guarantee color, size, temperament, or conformance to breed standards, after said puppy is in the care of the Buyer.

IMPORTANT!  NO REFUNDS WILL BE PROVIDED FOR ANY REASON.  SO PLEASE MAKE SURE THIS IS THE PUPPY YOU WANT BEFORE YOU SEND A DEPOSIT OR PAY FOR YOUR NEW PUPPY. THIS IS A PUPPY REPLACEMENT GUARANTEE ONLY!   Buyer’s acceptance of any puppy agrees that this transaction was consummated within the state of Missouri and consents to the application of all Missouri laws and to the jurisdiction of Missouri courts.  Any dispute is to be settled by arbitration in Johnson County, Missouri. This warranty constitutes the complete warranty between the seller, Walnut Creek Kennel, and the buyer, (listed by signature below) and no other representations, promises, or warranties apply, either stated or implied.
